  3. Certain Products may be personalised using information provided by the Buyer.
  4. Information that a Product is personalised is displayed on the Product page before the Order is placed.
  5. Product photographs, graphics and visualisations are intended to represent the appearance of Products as accurately as possible.
  6. Products made by hand or from natural materials, particularly wood, may show natural differences in colour, texture, grain or finish.
  7. The natural characteristics of a material do not in themselves constitute a lack of conformity with the contract, provided that the Product retains the characteristics, functionality and appearance that the Buyer may reasonably expect on the basis of the offer.

§4. Placing Orders

  1. Orders may be placed through the Store at any time.
  2. The Store accepts Orders exclusively for delivery within Poland.
  3. To place an Order, the Buyer:
    • selects a Product,
    • selects the available variants,
    • provides the required information,
    • for a Personalised Product, provides the information required to complete the personalisation,
    • selects a delivery method,
    • reviews the Order summary,
    • accepts these Terms and Conditions,
    • places the Order using a button that clearly states that placing the Order entails an obligation to pay.
  4. Before placing an Order, the Buyer is informed of:
    • the Product's main characteristics,
    • the Product price,
    • delivery costs,
    • the total amount payable.
  5. The Buyer should provide correct and up-to-date information necessary to process the Order, including a delivery address located in Poland.
  6. After the Order has been placed, confirmation that it has been received is sent to the email address provided by the Buyer.
  7. The sales contract is concluded when the Buyer receives confirmation that the Order has been accepted for processing.
  8. For delivery to a collection point, confirmation that the Order has been accepted for processing is sent after the specific collection point and carrier have been agreed with the Buyer.
  9. If the information provided by the Buyer is incomplete, ambiguous or prevents the Order from being processed correctly, the Seller may contact the Buyer for clarification.

§5. Personalised Products

  1. A Personalised Product is made on the basis of information, selections or materials supplied by the Buyer.
  2. Before confirming the Order, the Buyer should carefully check all information intended for personalisation, in particular:
    • name,
    • inscription,
    • date,
    • artwork,
    • colour,
    • size,
    • layout,
    • other individually specified elements.
  3. If the Buyer notices an error after placing the Order, the Buyer should contact the Seller as soon as possible at info@setterlabel.com.
  4. If production of the Product has not yet begun, the Seller will allow the personalisation details to be changed where reasonably possible.
  5. Once production of the Product has begun, it may no longer be possible to change the personalisation.
  6. The Seller is not liable for errors in personalisation content supplied by the Buyer if the Product was made in accordance with the information provided.
  7. The above does not limit the Seller's liability if the Product is made differently from the Buyer's correctly submitted Order.

§6. Prices

  1. All prices in the Store are stated in Polish zloty.
  2. The price displayed with a Product is the price the Buyer is required to pay for that Product.
  3. Delivery costs are shown separately.
  4. The total amount payable is presented to the Buyer before the Order is placed.
  5. The Seller may change Product prices and organise promotions.
  6. A price change does not affect Orders for which a contract has already been concluded.
  7. When announcing a price reduction, the Seller provides the information required by applicable law, including, where required, the lowest price of the Product during the relevant period before the reduction was introduced.

§7. Payments

  1. Payment for an Order is currently made by bank transfer to the account specified by the Seller.
  2. Bank transfer details are provided to the Buyer during the ordering process or in an email concerning the Order.
  3. The Order number, if assigned, should be included in the transfer reference.
  4. Processing of the Order begins after the full amount due has been credited to the Seller's account.
  5. If payment is not received, the Seller may contact the Buyer to establish whether the Order should still be processed.
  6. The Seller does not automatically issue a sales document for every Order.
  7. At the Buyer's request, the Seller issues a receipt or invoice in accordance with applicable law.

§8. Processing time

  1. Due to the nature of the Products offered, many are prepared only after an Order has been received.
  2. The standard Order processing time is usually up to 7 business days, calculated from the date on which payment is credited, unless a different time is stated for a particular Product.
  3. Processing time means the time required to prepare the Order and hand the parcel over to the carrier.
  4. Processing time does not include the time required by the carrier to deliver the parcel.
  5. During periods of increased Order volume, for more time-consuming personalisation or in other special circumstances, processing may take longer.
  6. If a longer processing time is known before an Order is placed, the relevant information will be presented to the Buyer before purchase.
  7. If an unforeseen delay arises after the Order has been accepted, the Seller will inform the Buyer of the delay and the expected processing date.
  8. The above does not limit any rights available to the Buyer under applicable law.

§9. Delivery

  1. Sales and delivery are carried out exclusively within the territory of the Republic of Poland.
  2. Orders are delivered by courier or to a collection point, according to the methods available in the Store when the Order is placed.
  3. Delivery to a collection point costs PLN 15, while courier delivery costs PLN 20. The current delivery cost is always shown before the Order is placed. Free delivery may apply when the threshold stated in the Store is reached.
  4. Due to the possibility of using different carriers, the specific carrier and collection point are agreed with the Buyer by email or telephone after the Order has been placed.
  5. The Seller proposes an available collection point, taking into account the Buyer's delivery location and preferences. The collection point and carrier must be confirmed before payment and before the Order is accepted for processing.
  6. A Buyer choosing delivery to a collection point should make the bank transfer only after receiving confirmation of the specific collection point and carrier.
  7. The delivery cost shown in the Order will not be increased without the Buyer's express consent.
  8. If a suitable collection point cannot be agreed, the Order will not be accepted for processing and the Buyer will not incur any costs. Any payment made before such information is received will be refunded without undue delay, no later than within 14 days.
  9. The Buyer should provide the correct:
    • delivery address or information needed to select a collection point in Poland,
    • telephone number,
    • email address,
    • and any other details required to dispatch the parcel correctly.
  10. After dispatch, the Buyer may receive information enabling the parcel to be tracked.
  11. The estimated delivery date provided by the carrier is not the Order processing time stated by Setter Label.
  12. If a parcel is returned to the Seller because it was not collected, the Seller will contact the Buyer to agree on the next steps.
  13. Resending the parcel at the Buyer's request may require payment of the actual cost of redelivery if the return was not caused by circumstances for which the Seller is responsible.

§10. Right of withdrawal – non-personalised Products

  1. As a rule, a Consumer who has concluded a distance sales contract has the right to withdraw from it without giving a reason within 14 days of receiving the Product, subject to statutory exceptions.
  2. For an Order covering several Products delivered separately, the period begins on the day the last Product is received.
  3. To exercise the right of withdrawal, the Consumer should send the Seller an unequivocal statement of withdrawal.
  4. The statement may be sent in particular:
    • by email to info@setterlabel.com,
    • or in writing to the Seller's address specified in §1.
  5. The Consumer may use the model form at the end of these Terms and Conditions, but is not required to do so.
  6. Sending the statement before the deadline is sufficient to meet the deadline.
  7. The Consumer should return the Product without undue delay and no later than 14 days after informing the Seller of the withdrawal.
  8. Before sending the Product, the Consumer may contact the Seller to agree on a convenient method of return.
  9. The Consumer bears the direct cost of returning the Product following withdrawal unless the Seller expressly agrees to bear that cost.
  10. The Seller refunds the Consumer the Product price and the original delivery costs incurred, up to the amount corresponding to the least expensive standard delivery method offered in the Store.
  11. The refund will be made no later than 14 days after the Seller receives the statement of withdrawal.
  12. The Seller may withhold the refund until the Product is received or until the Consumer provides proof of return, whichever occurs first.
  13. The refund will be made using the same payment method used by the Buyer unless the Buyer expressly agrees to another method that does not incur any costs.
  14. The Consumer is liable for any diminished value of the Product resulting from handling beyond what is necessary to establish its nature, characteristics and functioning.

The rules concerning the 14-day withdrawal period and reimbursement of delivery costs follow the current information published by the Polish Office of Competition and Consumer Protection (UOKiK).

§11. Personalised Products – no right of withdrawal

  1. The right to withdraw from a distance contract does not apply to a non-prefabricated Product made to the Consumer's specifications or intended to meet the Consumer's individual needs.
  2. This applies in particular to Products made:
    • with an individual name,
    • with custom wording,
    • with individual artwork,
    • with engraving,
    • according to another individual design or instruction from the Buyer.
  3. Information that the Product is personalised and that the statutory right of withdrawal therefore does not apply is made available to the Buyer before purchase.
  4. The mere fact that a Product is made only after an Order is placed does not automatically result in the loss of the right of withdrawal.
  5. The exclusion applies to Products genuinely made to the Consumer's individual specifications or intended to meet the Consumer's individual needs.
  6. The absence of the ordinary 14-day right of withdrawal does not exclude or limit the right to make a complaint about a Product that does not conform to the contract.

The legal basis for this exclusion is Article 38(1)(3) of the Polish Consumer Rights Act.

§12. Complaints

  1. The Seller is liable to the Consumer for the Product's conformity with the contract in accordance with applicable law.
  2. A Product conforms to the contract in particular if it corresponds to:
    • its description,
    • type,
    • quantity,
    • quality,
    • functionality,
    • the agreed personalisation,
    • and other requirements agreed with the Buyer.
  3. A complaint may be submitted to:

info@setterlabel.com

  1. The complaint should preferably include:
    • full name,
    • Order number,
    • the Product concerned,
    • a description of the issue,
    • and the requested resolution.
  2. If it may assist in assessing the complaint, the Buyer may attach photographs of the Product.
  3. The absence of photographs, packaging or a receipt cannot in itself constitute grounds for refusing to accept a complaint.
  4. There is no need to return the Product before contacting the Seller.
  5. If the Product needs to be provided in order to handle the complaint, the Seller will agree with the Buyer on a convenient method of delivery or collection, for example through InPost.
  6. For a complaint relating to a Product's lack of conformity with the contract, the Consumer makes the Product available to the Seller and the Seller bears the costs of collection, repair or replacement.
  7. The Consumer may first request repair or replacement of the Product, subject to exceptions provided by law.
  8. In cases specified by law, the Consumer may also request a price reduction or withdraw from the contract.
  9. If the Product's lack of conformity with the contract is significant, the Consumer may, in cases provided by law, request a price reduction or withdraw from the contract without first requesting repair or replacement.
  10. The Seller is liable for a lack of conformity with the contract that existed when the Product was delivered and was disclosed within 2 years from that time, unless a longer period applies under the law.
  11. The Seller will respond to a Consumer complaint within 14 days of receiving it.
  12. Failure to respond within this period has the consequences specified by applicable law.
  13. The complaint rules also apply to Personalised Products.

§13. Products intended for dogs

  1. Products intended for dogs should be used for their intended purpose and in accordance with the instructions or safety information provided with the Product.
  2. The Buyer should select a Product that is appropriate for:
    • the dog's size,
    • the dog's age,
    • the intended use,
    • and the animal's individual characteristics and behaviour.
  3. Where justified by the type of Product, it should be used under the supervision of a responsible person.
  4. The condition of the Product should be checked before each use.
  5. A Product damaged in a way that may endanger the animal should no longer be used.
  6. The information in this section does not exclude or limit the Seller's liability under applicable law.

  4. The Customer may close the account at any time.
  5. A request to delete an account may be submitted using a function available in the Store or by email to info@setterlabel.com.
  6. Deleting an account does not delete data that the Seller is required or legally entitled to retain for a specified period, such as information relating to completed Orders.

§16. Newsletter

  1. Setter Label allows users to subscribe voluntarily to the newsletter.
  2. The newsletter may contain information including:

  1. By supplying the Seller with custom text, artwork, a photograph or other material intended for personalisation, the Buyer represents that they have the right to use that material for the purpose of processing the Order.
  2. The Buyer should not provide materials that are:
    • unlawful,
    • infringe third-party rights,
    • or contain content prohibited by law.
  3. Materials supplied by the Buyer may be used by the Seller only to the extent necessary to process the Order unless the Buyer separately consents to their use for another purpose.
